These Terms of Use (the "Terms") govern your access to and use of the SpiraCosplay mobile application and related services (the "Service") operated by SpiraCosplay Team ("SpiraCosplay", "we", "us"). By creating an account or using the Service, you agree to these Terms.

1) Eligibility (17+)
The Service is intended only for users aged 17 and older. By using the Service, you represent that you are at least 17 years old.
2) The Service
SpiraCosplay is a community-style space built for cosplay short video. You can browse a curated home feed, watch a full-screen vertical stream, publish your own videos with titles, character, event/setting, story, and hashtag tags, like content, and start private chats with other users.
3) Account Registration and Security
- You must provide accurate account information and keep it up to date.
- You are responsible for activities under your account and for keeping your login credentials confidential.
- You may not share, sell, or transfer your account without our permission.
4) User Content and License
"User Content" includes videos, images, text, messages, metadata (titles, hashtags, character/event/story), and other materials you submit through the Service.
You retain ownership of your User Content. However, you grant SpiraCosplay a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, cache, reproduce, transmit, display, perform, publish, translate, adapt (for formatting/technical delivery), and distribute your User Content for the purpose of operating, providing, promoting, and improving the Service. This license continues for as long as your User Content is on the Service and for a reasonable time thereafter for backups, caching, and legal compliance.
You represent and warrant that you have all rights necessary to grant this license and that your User Content does not violate any laws or third-party rights.
5) Community Rules and Prohibited Conduct
You agree not to:
- Post content that is unlawful, harmful, threatening, harassing, hateful, or sexually explicit in violation of applicable law.
- Post content that infringes intellectual property rights (including copyrighted music, video, or images) without permission.
- Impersonate others, misrepresent affiliations, or engage in fraud.
- Attempt to access accounts, systems, or data without authorization.
- Use the Service to distribute malware, spam, or to disrupt the Service.
- Collect or scrape data from the Service without permission.
We may remove content or restrict accounts to protect the community and the Service.
6) Private Messaging
Private chats are meant for respectful communication. You are responsible for what you send. We may take action against abuse reports or policy violations.
7) Virtual Currency and Paid Features
Publishing may require in-app currency. New users may receive a starting balance. You may be able to obtain additional currency through in-app purchase or other methods we may offer.
- Virtual currency has no cash value and is non-transferable except as we expressly permit.
- Purchases are processed by the platform provider (e.g., Apple). We do not receive or store your full payment card information.
- To the extent permitted by law and platform rules, all purchases are final and non-refundable.
8) Intellectual Property
The Service and its content (excluding User Content) are owned by SpiraCosplay or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service unless you have our written permission.
9) Third-Party Services
The Service may allow sharing via your device’s system share sheet or interaction with third-party services you choose. We do not control third-party services and are not responsible for them.
10) Termination
You may stop using the Service at any time. We may suspend or terminate your access, or remove content, if we reasonably believe you violated these Terms, created risk or legal exposure, or to protect the Service or users. Where appropriate, we may provide notice.
11) Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
12) Limitation of Liability
To the maximum extent permitted by law, SpiraCosplay will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid to SpiraCosplay for the Service in the 12 months before the event giving rise to the claim (or USD $50 if you paid nothing).
13) Indemnification
You agree to indemnify and hold harmless SpiraCosplay and its team members from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.
14) Governing Law and Dispute Resolution (Binding Arbitration)
These Terms are governed by the laws of SpiraCosplay’s principal place of business, without regard to conflict of laws rules.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration, and not in court, except that either party may seek injunctive or equitable relief for misuse of intellectual property or unauthorized access.
15) Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide reasonable notice (for example, within the Service) and update the effective date. Your continued use after the effective date means you accept the updated Terms.
16) Apple Acknowledgement (iOS Users)
If you use the Service on iOS:
- These Terms are between you and SpiraCosplay Team, not Apple.
- Apple has no obligation to provide maintenance or support services for the Service.
- Apple is a third-party beneficiary of these Terms and may enforce them against you.
